These Booking Terms & Conditions apply to photography sessions arranged through My Playa Photographer.
1. Role of My Playa Photographer
My Playa Photographer acts as a booking agent and intermediary between the client and the assigned local photographer in Mexico.
The photography session itself is performed by the assigned photographer. My Playa Photographer arranges and coordinates the booking on behalf of the photographer and assists with communication and scheduling.
The identity of the assigned photographer will be communicated to the client before the photography session.
2. Photography Services
The actual photography services, including the performance of the photo session, are provided by the assigned local photographer in Mexico.
Details such as the date, time, location, duration, package and agreed deliverables will be stated in the booking confirmation.
My Playa Photographer assists with the organization and coordination of these services but does not personally perform the photography services unless expressly stated otherwise.
3. Booking and Payment
Unless otherwise agreed, the total price of the photography session is divided into two payments:
50% booking payment payable at the time of booking through My Playa Photographer; and
50% remaining balance payable directly to the assigned photographer.
A booking is considered confirmed once the required booking payment has been received and the client has received a booking confirmation.
The booking confirmation will show the total session price, the amount already paid and the remaining balance payable to the photographer.
4. Remaining Balance
The remaining balance is payable directly to the assigned photographer according to the payment instructions provided for the booking.
My Playa Photographer does not collect the remaining balance unless expressly agreed otherwise.
5. Cancellation Policy
All payments and deposits are non-refundable, except where mandatory applicable law provides otherwise.
If the client's trip is canceled, the paid booking amount may be converted into a voucher valid for 12 months from the original photography session date.
To qualify for a voucher, the client must provide official documentation confirming the trip cancellation, such as written confirmation from an airline, hotel, accommodation provider or travel company.
The voucher may be applied toward a future photography session arranged through My Playa Photographer and is subject to photographer availability.
A voucher:
is valid for 12 months from the original session date;
has no cash value and cannot be exchanged for a refund;
may be used toward a future session of equal or greater value;
is subject to availability and current pricing at the time of rebooking; and
expires automatically if it is not used within the 12-month validity period.
Any amount exceeding the voucher value must be paid by the client according to the payment terms applicable to the new booking.
Where mandatory consumer law gives the client rights that cannot legally be excluded or limited, those rights remain unaffected.
6. Rescheduling
Requests to change the photography date or time are subject to the availability of the assigned photographer.
My Playa Photographer will make reasonable efforts to coordinate an alternative date or time, but availability cannot be guaranteed.
7. Bad Weather
Photography sessions in Mexico are subject to local weather conditions.
In the event of unfavorable weather, flexibility may be offered by adjusting the starting time of the session, subject to the photographer's availability and local conditions.
Weather conditions do not automatically entitle the client to a refund.
Whenever reasonably possible, My Playa Photographer and the assigned photographer will work with the client to determine the most suitable available starting time for the session.
Weather conditions can change quickly, particularly in tropical destinations, and decisions regarding any adjustment to the session time may therefore be made close to the scheduled session.
If a session cannot reasonably take place as originally scheduled due to severe weather or unsafe conditions, My Playa Photographer and the assigned photographer will work with the client to determine an appropriate alternative, subject to availability.
8. Photographer Unavailability
If the assigned photographer becomes unavailable due to illness, emergency or another circumstance beyond reasonable control, My Playa Photographer may assist in arranging a suitable replacement photographer.
If no suitable replacement can reasonably be arranged, the client will be informed as soon as practicable and the parties will seek an appropriate solution, such as rescheduling or reimbursement of amounts relating to services that cannot be provided.
Nothing in these Terms limits any mandatory rights the client may have under applicable law.
9. Location Conditions
Photography sessions in Mexico may be affected by beach conditions, access restrictions, hotel or resort policies, governmental restrictions or other local circumstances outside the reasonable control of the photographer or My Playa Photographer.
Where reasonably possible, the photographer and My Playa Photographer will cooperate with the client to find an appropriate alternative.
The client is responsible for obtaining any permissions required specifically because of a location selected by the client unless otherwise agreed in writing.
10. Punctuality
Clients should arrive at the agreed location at the agreed time.
Late arrival may reduce the available photography time where the photographer has subsequent bookings or where environmental conditions such as sunset limit the available shooting period.
An extension of the session cannot be guaranteed.
11. Photography Style and Creative Discretion
By booking a photographer, the client acknowledges the photographer's individual photographic and editing style.
The photographer retains reasonable creative discretion regarding composition, posing, lighting, selection and editing of the photographs, subject to the package and services agreed with the client.
12. Delivery of Photographs
The final edited photographs will be delivered within a maximum of 7 days after the photography session.
In most cases, delivery will take place sooner.
The delivery method and agreed number of photographs will be communicated as part of the package description or booking confirmation.
The assigned photographer is responsible for the photographic work and agreed photographic deliverables.
My Playa Photographer may assist with communication regarding delivery where necessary.
13. Client Cooperation
The client is responsible for providing accurate booking information and for communicating any important requirements before the session.
The client should inform My Playa Photographer or the photographer in advance of any specific accessibility requirements, location restrictions or other circumstances relevant to the photography session.
14. Image Usage
By booking a photography session, the client agrees that photographs created during the session may be used by My Playa Photographer for website, portfolio and social media purposes, unless the client expressly requests otherwise.
Clients who do not wish their photographs to be used for promotional purposes should communicate this preference in writing.
Any such request will be respected.
The client's personal information will be handled in accordance with the applicable Privacy Policy.
15. Complaints
Questions regarding booking coordination may be directed to My Playa Photographer.
Questions or complaints concerning the actual performance of the photography session or the photographic deliverables may involve the assigned photographer as the provider of those photography services.
My Playa Photographer will reasonably assist in facilitating communication between the client and photographer where appropriate.
16. Liability
Each party remains responsible for its own contractual obligations and conduct.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for intentional misconduct or other liability that cannot legally be excluded.
17. Independent Photographers
Photographers booked through My Playa Photographer may operate as independent photography professionals.
Unless expressly stated otherwise, they are not employees of My Playa Photographer.
My Playa Photographer's role is to arrange and coordinate the photography booking as described in these Terms.
18. Applicable Mandatory Law
These Terms do not restrict any mandatory consumer rights that apply to a client under applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain unaffected to the extent permitted by law.
